Online Purchases Terms

1. Introduction


Welcome to Crafty Monkey. These terms and conditions outline the rules and regulations for the purchase of goods from our website. By placing an order with Crafty Monkey, you agree to be bound by these terms. If you do not agree to these terms, please refrain from making a purchase.

3. Eligibility


To purchase goods from Crafty Monkey, you must be at least 18 years of age and legally capable of entering into binding contracts.


4. Goods and Ordering Process


4.1. Description of Goods: Any description is for illustrative purposes only and there may be small discrepancies in the size and colour of the Goods supplied as we use different suppliers so items can vary.

4.2. Hand Painted Personalised Goods: It is your responsibility to ensure that any information or specification you provide is accurate. If you make an error or change your mind on the personalisation then if you email us at hello@mycraftymonkey.com asap. If we have already started painting your item we may not be able to change it from your original order. Also note, with our personalised products they are handpainted and we have different artists painting up the pieces so they will always be subject to some variation.

4.3. Subject to Availability: Our stock levels on our website are not linked to our inventory and we run a busy studio where we sell items all the time so all Goods which appear on the Website are subject to availability.


4.4. Placing an Order: To place an order, select the products you wish to purchase and add them to your cart. Proceed to checkout and follow the instructions to complete your purchase. By completing the checkout process, you are making an offer to purchase the goods at the price stated.


4.6. Order Confirmation: Upon placing your order, you will receive an order confirmation email from us. This email does not constitute acceptance of your order. A contract between us is only formed when we dispatch the goods to you.


4.7. Order Rejection: We reserve the right to refuse or cancel any order at our discretion, including but not limited to situations where the product is out of stock, where we identify an error in pricing or product information, or if we suspect fraudulent activity.



5. Pricing and Payment


5.1. Pricing: All prices on our website are in GBP (£) and include VAT at the applicable rate. We endeavour to ensure that all pricing information on our website is accurate. However, if we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option to reconfirm the order at the correct price or cancel it.


5.2. Payment: Payment must be made in full at the time of placing your order. We accept payment via credit or debit cards. All payments are subject to validation checks and authorisation by the payment provider.


5.3. Price Changes: Prices are subject to change without notice. However, once an order has been placed, the price at the time of order will be honoured unless clause 5.1 applies.


6. Delivery


6.1. Delivery Locations: We deliver to all areas of the United Kingdom that do not incur and additional postage charge.


6.2. Delivery Times: We aim to dispatch orders within 3 working days. Delivery times may vary depending on your location and the delivery option chosen at checkout. We will not be held responsible for delays caused by events outside our control.


6.3. Delivery Charges: Delivery charges will be applied at checkout based on your delivery the delivery option selected. If ordering a lot of items it may incur an additional charge for postage. We will send you a payment link to pay.


6.4. Risk and Ownership: Ownership of the goods will pass to you when we receive full payment for the goods. Risk of loss or damage to the goods will pass to you upon delivery (unless pottery - see clause 6.5)


6.5 Risk of Breakage of Pottery in Transit: We advise you to collect pottery items from our studio rather than purchase postage. We package items well but can take no responsibility for what happens once the item has entered the postal system and pottery is not an item that can be insured hence choosing to have it posted is at your risk.


7. Returns and Cancellations


7.1. Right to Cancel: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving the goods without giving any reason. To exercise your right to cancel, please contact us at hello@mycraftymonkey.com before the 14-day period expires.


7.2. Returns Process: If you wish to return goods, please ensure they are in their original condition and packaging. Contact us to arrange the return, and we will provide instructions. You must return the goods within 14 days of notifying us of your cancellation.


7.3. Refunds: We will process your refund within 14 days of receiving the returned goods or proof of return. Refunds will be issued to the original payment method. Please note that we may deduct a reasonable amount from the refund if the goods show signs of use.


7.4. Exemptions: The right to cancel does not apply to personalised items, perishable goods, or items that have been sealed for hygiene reasons and have been unsealed after delivery.


8. Faulty or Damaged Goods


8.1. Reporting Issues: If you receive faulty or damaged goods, please contact us immediately at hello@mycraftymonkey.com. We will arrange for a replacement or refund, as per your statutory rights. This excludes pottery items for take out kits.


8.2. Faulty Goods: Under the Consumer Rights Act 2015, you have the right to return goods that are faulty or not as described. You may be entitled to a repair, replacement, or refund, depending on the circumstances.


9. Limitation of Liability


9.1. Extent of Liability: Our liability for losses you suffer as a result of us breaking this contract is limited to the purchase price of the goods you ordered.


9.2. Exclusions: We will not be liable for any loss or damage caused by us in circumstances where:

  • There is no breach of a legal duty of care owed to you by us.

  • Such loss or damage is not a reasonably foreseeable result of any such breach.

  • Any increase in loss or damage results from a breach by you of these terms and conditions.

11. Governing Law


These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
